A Notary Public or Notarial Services Attorney is an individual appointed by a government authority of a specific country according to legal requirements. Their role includes drafting contracts, certifying signatures on documents, witnessing documents, verifying the authenticity of documents as true copies of the original, administering oaths, and performing other legally authorized duties based on the practices of each country.

The documents for notarizing are mostly intended for use abroad or at embassies. A common certification statement used is:

“I certify that this copy is a true copy of the original document.” or “Certified True Copy of Original by …”

In Thailand, There is no official Notary Public, but there are Notarial Services Attorneys, who are lawyers authorized by the Lawyers Council of Thailand to certify documents.

1. Foreign Businesses and Companies

For a business that is involved between countries, to certify the signatures of company directors on documents may be required. As well as opening bank accounts, various contracts or agreements.

2. Buying and Selling Real Estate

Buying and selling property may require a certified ownership document, such as a title deed, passport or sales agreement. To do a transaction on behalf of others shall require a notary as well.

If documents are intended for use in foreign countries, such as land sale contracts or company registration documents, they may require certification from the Department of Consular Affairs, Ministry of Foreign Affairs.

Hague Apostille Convention

The Hague Apostille Convention, formally known as the Convention Abolishing the Requirement of Legalization for Foreign Public Documents, is an international agreement established in 1961. Its primary goal is to simplify and expedite the process of document authentication between countries.

Currently, Thailand is in the process of preparing to join the Apostille Convention. This will simplify the document legalization process for international use. In June 2023, representatives from the Consular Department, Ministry of Foreign Affairs held discussions with the HCCH Secretary-General to prepare for joining the Convention.

Thus, even though Thailand has been a member of HCCH since 2021, it has not yet become a party to the Apostille Convention and must still follow the traditional document legalization procedures for Thai documents used abroad.
